When a couple decides they cannot pursue a divorce

The decision of whether or not to get a divorce can be one of the most difficult ones there is. Also, it can be a decision in which far more factors are in play than just how broken a marriage is. Things like religious beliefs and financial matters can have impacts on how viable of a choice a divorce is for a couple that is experiencing significant marital troubles.

Thus, situations can sometimes arise in which a couple concludes that their marriage is broken and cannot be fixed, but decides that divorce is not something that would work for them.

Are couples in such a situation without any options? Thankfully, here in Georgia, the answer to this question is no. There is an alternative for couples whose marriage is broken but have decided that they cannot get divorced. This alternative is called separate maintenance

When a married couple decides to go the separate maintenance route, one thing that will often be very impactful is what sort of separate maintenance agreement they ultimately end up reaching. Such an agreement can control a variety of very important issues, like child custody, child support, division of assets and division of debt. Thus, the terms of such an agreement can have some very long-lasting effects.

This is among the reasons why, just as is the case when an individual is divorcing a spouse, it can be important for a person who is going the separate maintenance route when it comes to their marriage to seek out a legal professional to help them with protecting their interests and rights in upcoming negotiations and proceedings.
