Protecting finances in a Georgia divorce

While it can be beneficial to retain legal counsel to help with a divorce, it may also be worthwhile to have the assistance of a financial adviser as well. Doing so may make it possible to craft a settlement that makes the most sense as it relates to an individual's money. Although an individual may want the marital home in a settlement, if the other spouse takes out a loan secured by the property, whoever owns it could be upside down without knowing it.

As an attorney has knowledge of the law, a financial planner has knowledge of financial issues that legal counsel may not fully understand. For instance, trading some or all of an investment portfolio for a home to raise the kids in could seem like a fair trade on the surface. However, a financial planner may be able to explain that the portfolio has a chance to grow in value while the house requires upkeep and additional costs.

A great reason to hire a financial planner is that he or she may be able to locate hidden assets. This may entitle the other spouse to a larger settlement if it can be proven that such assets exist.

The end of a marriage can be an emotionally draining event, and as a result, people who are going through the process often want to get it over with as quickly as possible. Those who do often run the risk of agreeing to certain demands that could prove financially troublesome down the road. It can thus be advisable for a divorcing person to obtain the assistance of a family law attorney in negotiating an equitable settlement.
