Religious freedom and adoption in Georgia

On March 31, a federal judge ruled that a law banning same-sex adoption in Mississippi was unconstitutional. The law had been in place for the past 16 years, but the judge ruled that it violated the equal protection clause based on a 2015 ruling by the Supreme Court. That ruling made same-sex marriage legal in all 50 states, and the judge reasoned that one of the benefits of marriage was the right to adopt.

Representatives from the Campaign for Southern Equality as well as four same-sex couples brought forth the lawsuit that led to the judge's ruling. States such as Florida and Nebraska recently overturned bans on same-sex adoption, and advocacy groups claimed that Mississippi was the only state yet to overturn its ban.

The governor of Mississippi signed a controversial religious freedom bill in early April. According to such legislation, it would be legal for businesses and other groups to deny services to those who may identify as LGBT. This would include the ability to deny such individuals the right to adopt or foster children.

In family law cases involving children, a judge will typically put the best interests of the child above all else. This is true whether a parent seeks custody of a child or an individual or couple wishes to adopt a child. Those who are in a same-sex relationship or anyone else who wants to go through with an adoption or assume custody of a child may wish to talk to an attorney who has experience with these types of matters.
