Reasons to get a prenuptial agreement

For many Georgia couples who are planning on getting married, determining whether or not they want to get a prenuptial agreement is just one decision they will have to make. In fact, some couples forgo getting a prenuptial agreement signed because they believe that it indicates that one or both individuals do not believe that the marriage will last. However, there are many positives when it comes to entering into one.

Despite what some may think, a prenuptial agreement does not mean that one or both individuals are anticipating getting a divorce in the future. Prenups require both individuals to fully disclose all of the assets they are bringing into the marriage. This means that the couple will go into the marriage knowing their debt while keeping inheritances and separate property safe.

Another reason couples may want to get prenuptial agreements is to protect their children. For example, a prenup can protect the financial well-being of children that were born prior to the marriage. It can also state which assets should be given to any children that are born during the marriage should one or both parents die. If a divorce does occur later on, the prenup prevents arguments over assets, which can allow for a clean break.

If a couple did not get a prenuptial agreement, dividing up the property at the end of a marriage can be difficult and time consuming. However, a family law attorney may assist with protecting property that a client owned prior to getting married. Additionally, counsel can help clients determine which marital assets they want to keep, like the family home and vehicle.
