Can the Georgia Department of Insurance help me with my claim?

Anytime you must deal with insurance in Georgia, whether it is workers’ compensation, auto insurance or any other type of insurance, you can expect to have to submit a lot of paperwork and wait for the issue’s resolution. This is typical of the insurance industry. However, if other problems come up or you feel your treatment is not fair, you may have options to get the issue fixed. According to the Office of Insurance and Safety Fire Commissioner, the Department of Insurance is an oversight organization that makes sure insurance companies follow the law.

While you can make a complaint to the Department, it does have its limitations. For example, if you simply disagree with an insurance company’s findings, the Department cannot help you. Its employees are not legal representatives. They only take complaints. They cannot give you advice or make judgments on the facts of the case.

You can use the Department to file a complaint about wrongdoing and not following the insurance laws only. This might include the cancellation of your policy or failure to issue a refund. You can also make a complaint against an individual adjuster.

If you want to file a complaint, you should first contact your insurer to discuss the issue. If that does not fix the issue, then you can issue a complaint with the Department. It will do an investigation and let you know the results. Keep in mind that the Department focuses only on illegal activities.
